TERMS OF USE

Definitions

  • Reflection period: Timeframe for consumers to exercise the right of withdrawal.
  • Consumer: A natural person acting for non-commercial purposes (unrelated to trade, business, etc.).
  • Day: A calendar day.
  • Digital content: Data provided in digital form.
  • Permanent contract: Covers regular delivery of goods/services/digital content over a specified period.
  • Durable data carrier: A tool (e.g., email) allowing storage of information for future access/copying.
  • Right of withdrawal: Consumers may terminate a distance contract during the reflection period.
  • Entrepreneur: A person/entity providing products/services/digital content remotely to consumers.
  • Distance contract: A contract formed remotely (via technology) without in-person interaction.
  • Sample withdrawal form: Included in Annex I (if withdrawal rights apply).
  • Remote communication technology: Tools enabling contract formation without in-person meetings.

Applicability

These terms apply to all offers and distance contracts between the Entrepreneur and Consumers.

  • Before the contract is formed, consumers must have access to these terms. If not feasible, the Entrepreneur will explain how to review them and send them free of charge upon request.
  • For electronic contracts, terms may be provided electronically (storable on durable data carriers) or via a link, with free delivery upon request.
  • If specific product/service terms apply, the above rules hold. In case of conflicts, consumers may rely on the most favorable terms.

Article 4 – Quotation

Offers must include full, accurate descriptions of products/services/digital content (with detailed info for assessment) and true images. Obvious errors in offers do not bind the Entrepreneur. Offers must also outline consumer rights/obligations upon acceptance.

Contract Formation

A contract is formed when the consumer accepts the offer and meets specified conditions.

  • Electronic acceptance: The Entrepreneur must immediately confirm receipt electronically. Consumers may withdraw until confirmation.
  • Electronic contracts: The Entrepreneur will implement security measures for data transmission and electronic payments.
  • Eligibility checks: The Entrepreneur may verify the consumer’s ability to pay; if concerns arise, it may reject the order (with justification) or impose conditions.
  • Post-delivery information: By delivery, the Entrepreneur must provide (in writing or storable form): complaint submission details, withdrawal terms (or exclusion), guarantee/after-sales info, prices (including taxes/shipping), termination rules (for contracts over 1 year/indefinite), and a sample withdrawal form (if applicable). For forward transactions, this applies only to the first delivery.

Right of Withdrawal

Consumers may terminate product purchase contracts within 14 days (no reason required) via email to [email protected].

  • Start date:
    • Single product: Day after receipt by the consumer/designated third party (not the carrier).
    • Multiple products in one order: Day after receipt of the last product.
    • Batched/partial deliveries: Day after receipt of the last batch/part.
      Note: The Entrepreneur may restrict withdrawal for orders with staggered delivery dates if disclosed upfront.

Pricing

Prices remain fixed during promotional periods (except for tax changes) and include VAT.

Delivery and Performance

The Entrepreneur will process orders carefully, with delivery within 30 days (unless agreed otherwise).

  • Delays, partial fulfillment, or inability to deliver must be notified to the consumer within 30 days of ordering. The consumer may then terminate the contract, receive a full refund, and claim compensation.
  • The Entrepreneur bears risk of damage/loss until delivery to the consumer or their representative.

Complaints Procedure

  • Complaints (regarding contract performance) must be submitted clearly and promptly after discovering the issue.
  • The Entrepreneur will respond within 14 days; complex complaints will receive an acknowledgment within 14 days with a timeline for resolution.
  • Consumers must allow 4 weeks for mutual resolution; unresolved issues proceed to dispute resolution.

Article 17 – Additional Conditions

Additional terms must not harm consumers and must be in writing or storable form (accessible to consumers).
